The Search Agreement
Extreme Solutions offers Retained Search Agreements, Engaged Search Agreements, and Contingency Search Agreements. Do you want us to find a Purple Squirrel? A Purple Squirrel is a rare candidate that is almost impossible to find. Depending on the rarity and the difficulty of the search will depend on which agreement is best for you. Clients who have experienced an unsuccessful-unending search, usually find that a Retained or Engaged search works best.
Features of our Retained Search Agreement
The Company's permanent placement fees are charged on an installment basis and are payable in 1/3 increments with the first payment at the signing of the Agreement, the second after 30 days and the third after 60 days. The Client is paying for the Company's efforts over a 90 day period and this service is considered complete after 90 days. The Client agrees to completely partner with the Company by referring all candidates and candidate files to the Company. The Company is orchestrating the search and is the exclusive partner for finding the right candidate. All fees are non refundable.
Features of our Engaged Search Agreement
Much like a combination of the Retained and Contingency Agreements, the Engaged Agreement gives the best of both worlds. The Company's permanent placement fees are charged a 1/3 Engagement fee with payment at the signing of the Agreement. The other 2/3's of the fee is charged on a contingency basis and payable only if the Client hires a candidate who has been presented to the Client through the Company's orchestration of the hiring process, regardless of where the candidate originated. In addition, this fee is payable should the Client or anyone else in the Client's company, its divisions, subsidiaries, or affiliates, through the Company's efforts, hire the Company's candidate within 18 months after the most recent contact with the Client concerning the Company's candidate. The 1/3 Engagement fee is non refundable. The Client agrees to completely partner with the Company by referring all candidates and candidate files to the Company. The Company is orchestrating the search and is the exclusive partner for finding the right candidate.
Features of our Contingency Search Agreement
The Company's permanent placement fees are charged on a contingency basis and are payable only if the Client hires a candidate who has been presented to the Client through the Company's efforts. In addition, this fee is payable should the Client or anyone else in the Client's company, its divisions, subsidiaries, or affiliates, through the Company's efforts, hire the Company's candidate within 18 months after the most recent contact with the Client concerning the Company's candidate.
It is acknowledged that all information furnished by the candidate has not been independently verified by the Company. The Client acknowledges that it is the Client’s responsibility to make background checks, reference checks and other verifications, unless otherwise specified.
The Company's normal permanent placement fee is calculated as thirty (30%) of the hired candidate's first year's total compensation which includes base salary, draw, guarantee, and signing bonus.
Because without communications nothing can be done, Client agrees to allow free access to the hiring managers to the Company. As time is of the essence, Client agrees to communicate with the Company, expeditiously answering e-mails and voice mails within two (2) business days.
If an employee hired as a result of the Company's efforts terminates for any reason, except as noted below, or is terminated from his/her position within three (3) months from the start of employment, the Company will provide a free 90 day replacement search. If an employee terminates within three (3) months for reasons beyond their direct control related to scope of work or work environment, the Company may provide a replacement search at the Company's standard rates. We require that the Client notify the Company in writing within five (5) working days concerning all relevant information about the termination.
Forfeiture of Guarantee
Forfeiture of Guarantee. If Client fails to perform its obligations to this agreement then Extreme Solutions shall, at its discretion, no longer be bound by said agreement.
During the term of this Agreement and for a period of one (1) year following the date the Company's personnel ceases to perform services pursuant to this Agreement, the Company's personnel shall not directly or indirectly solicit employees for employment from the Client's company.
The Company will invoice the Client when the candidate begins employment. The negotiated terms are net upon receipt of invoice.
